Your Rights Under the Mental Health Act

Right to an Independent Mental Health Advocate (IMHA)
If you are detained under the Mental Health Act, you have a legal right to an IMHA โ€” a free, independent person who can support you, explain your rights, and help you be heard. Ask your ward staff for this immediately.

Right to Challenge Detention
You can apply to the Mental Health Tribunal to challenge being sectioned. You are entitled to free legal representation for this. Contact a solicitor who specialises in mental health law immediately.

Right to Refuse Treatment
In most circumstances you have the right to refuse medication and treatment. After 3 months of sectioning this becomes more complex โ€” seek legal advice. You can always ask for a second opinion.

Right to Access Your Records
You have the right to see your NHS mental health records under the UK GDPR. Submit a Subject Access Request (SAR) to your NHS Trust in writing. They must respond within 1 month.
